No, you cannot go to jail or be arrested for not paying your credit cards, bank overdraft's, Bank mortgages, student loans, hospital bills, utility bills, phone bills etc. These are all considered "civil debts" and you cannot be arrested for not paying civil debts. In fact if the debt collectors does threaten you with any jail time you have a great case to Sue them as it is completely illegal for them to make such threats and they are in breach of the Law. They can however try and sue you, but this is very rare and actually only 1% of debt collectors will sue you. - Also to this point they cannot threaten to Sue you unless they actually intend on doing this! If they do they are also in breach of the Law. For more information on this check out our section, what happens when a debt collector trys to Sue me.
The only debts you can goto jail for are -
- Not paying your taxes
- Not paying child support
